Applicable Locations: Texas, Oklahoma, and Other Authorized Rental Locations

This Rental Participant Agreement and Release of Liability (“Agreement”) is entered into between ThrillFleet, LLC (“ThrillFleet”) and the individual accepting this Agreement (“Participant”).

This Agreement applies to adult Renters, Authorized Operators, Passengers, and other adult individuals participating in recreational activities involving vehicles rented or provided by ThrillFleet, including all-terrain vehicles (ATVs), utility terrain vehicles (UTVs or side-by-sides), dirt bikes, and related recreational equipment.

By electronically signing or otherwise affirmatively accepting this Agreement, Participant acknowledges the inherent risks of off-road recreational activities, voluntarily assumes applicable risks, and agrees to the releases, responsibilities, and other provisions stated herein to the fullest extent permitted by applicable law.

This Agreement supplements ThrillFleet’s Terms of Service, applicable rental conditions, safety requirements, and Risk and Protection Disclosures. Financial obligations, Security Deposits, cancellations, vehicle damage procedures, and related rental conditions are additionally governed by those documents.

Minor passengers are subject to ThrillFleet’s separate Minor Passenger Parental Consent, Assumption of Risk & Release of Liability Agreement. An adult Participant’s acceptance of this Agreement does not automatically establish acceptance on behalf of another individual.

1. VOLUNTARY PARTICIPATION AND ASSUMPTION OF RISK

1.1 Voluntary Participation in High-Risk Activities

PARTICIPANT ACKNOWLEDGES THAT OPERATING OR RIDING IN RECREATIONAL OFF-ROAD VEHICLES IS AN INHERENTLY DANGEROUS ACTIVITY THAT MAY RESULT IN SERIOUS BODILY INJURY, PERMANENT DISABILITY, PARALYSIS, PROPERTY DAMAGE, OR DEATH.

Participant voluntarily elects to participate in these activities with full knowledge that off-road recreation involves risks that cannot be entirely eliminated through experience, supervision, vehicle maintenance, or safety precautions.

1.2 Acknowledgment of Specific Risks

Participant understands that off-road recreational activities involve known and unknown hazards, including but not limited to:

  • Vehicle collisions, rollovers, and loss of control.
  • Passenger ejection, impacts, and crushing injuries.
  • Mechanical failures, equipment defects, tire failures, and component malfunctions.
  • Uneven terrain, rocks, ruts, steep slopes, washouts, and unstable surfaces.
  • Mud, deep water, flooding, submersion, and concealed obstacles.
  • Dangerous weather, poor visibility, dust, and changing trail conditions.
  • Actions or errors of other drivers, passengers, and third parties.
  • Operator inexperience, misjudgment, distraction, or loss of vehicle control.
  • Delayed emergency response, limited cellular service, and remote riding locations.

Participant understands that these risks may result in severe injury or death even when vehicles are operated cautiously.

1.3 Express Assumption of Risk

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PARTICIPANT KNOWINGLY AND VOLUNTARILY ASSUMES THE INHERENT RISKS ASSOCIATED WITH OPERATING, RIDING IN, TRANSPORTING, OR OTHERWISE PARTICIPATING IN ACTIVITIES INVOLVING THRILLFLEET VEHICLES.

Participant further acknowledges that the activities may involve risks associated with ordinary negligence by ThrillFleet or other persons, as specifically addressed in the express release contained in Section 3.

Nothing in this section waives liability that cannot lawfully be waived.

2. ELIGIBILITY, PHYSICAL CONDITION, AND SAFETY REQUIREMENTS

2.1 Operator Eligibility

Renters and Authorized Operators must ordinarily be at least twenty-five (25) years of age, possess a valid government-issued driver’s license, and meet ThrillFleet’s identity verification and eligibility requirements.

ThrillFleet may approve exceptions to its minimum operator age requirement on a case-by-case basis, provided such exceptions comply with applicable law and relevant operating restrictions.

Only individuals expressly approved by ThrillFleet may operate rented vehicles.

Adult Passengers are not subject to ThrillFleet’s standard minimum operator age requirement but must comply with applicable passenger eligibility and safety requirements.

Minors may participate only as authorized passengers in accordance with ThrillFleet’s separate parental consent agreement and applicable rental restrictions.

2.2 Physical and Mental Fitness

Participant represents that they possess the physical ability, judgment, and capacity reasonably necessary for their intended participation.

Authorized Operators are responsible for evaluating their own experience, skill level, fatigue, medication effects, and other circumstances that may affect safe vehicle operation.

2.3 Impairment Prohibition

Operation of ThrillFleet vehicles while impaired by alcohol, drugs, medication, fatigue, or any other condition that substantially compromises judgment or motor coordination is prohibited.

Participants must not knowingly permit an impaired person to operate a rented vehicle.

2.4 Protective Gear and Vehicle Safety Equipment

All Participants must comply with applicable federal, state, and local laws, riding-area regulations, and ThrillFleet’s mandatory safety requirements.

Dirt Bikes: All dirt bike operators must wear a properly fitted, DOT-approved motorcycle helmet and protective over-the-ankle riding boots while operating a ThrillFleet dirt bike.

ATVs and Side-by-Sides: Except where required by applicable law, riding-area regulations, or expressly established ThrillFleet rental conditions, the selection and use of personal protective gear, including helmets, eyewear, and protective clothing, is at the Participant’s discretion.

Vehicle Restraints: Every occupant of a side-by-side must properly use installed seat belts or safety harnesses, remain in a designated seating position, and keep arms, legs, and other body parts inside the vehicle during operation.

Participants shall not remove, disable, modify, or interfere with manufacturer-installed safety equipment.

Participant acknowledges that vehicle manufacturers may instruct or recommend the use of helmets, protective eyewear, and additional protective equipment even when not required by applicable law. Declining recommended protective equipment may significantly increase the risk of injury or death.

Nothing in this provision excuses noncompliance with mandatory legal requirements or eliminates any nonwaivable legal duty.

2.5 Operating Restrictions and Safety Instructions

Participants must comply with ThrillFleet’s operating restrictions, manufacturer limitations, designated riding boundaries, and riding-area regulations.

Unauthorized drivers, reckless operation, intentional misuse, prohibited stunts, unlawful activities, and knowingly continuing to operate an unsafe vehicle are prohibited.

Participants must promptly report accidents, mechanical problems, warning indicators, or unsafe conditions and discontinue operation when continued use could create a safety hazard or cause additional damage.

3. EXPRESS RELEASE OF LIABILITY AND HOLD HARMLESS AGREEMENT

3.1 Express Release of Ordinary Negligence

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PARTICIPANT EXPRESSLY RELEASES, WAIVES, AND DISCHARGES THRILLFLEET, LLC, ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND REPRESENTATIVES (COLLECTIVELY, THE “RELEASED PARTIES”) FROM CLAIMS FOR PERSONAL INJURY, DEATH, PROPERTY DAMAGE, OR OTHER LOSSES ARISING OUT OF THE ORDINARY NEGLIGENCE OF ANY RELEASED PARTY IN CONNECTION WITH THE RENTAL, INSPECTION, MAINTENANCE, REPAIR, PREPARATION, DELIVERY, HANDOFF, POSSESSION, OPERATION, OR USE OF A THRILLFLEET VEHICLE.

THIS RELEASE EXPRESSLY INCLUDES CLAIMS ALLEGING THAT THE ORDINARY NEGLIGENCE OF A RELEASED PARTY CONTRIBUTED TO A COLLISION, ROLLOVER, MECHANICAL FAILURE, EQUIPMENT MALFUNCTION, UNSAFE VEHICLE CONDITION, OR OTHER INCIDENT RESULTING IN INJURY, DEATH, OR PROPERTY DAMAGE.

PARTICIPANT ACKNOWLEDGES THAT THIS PROVISION IS INTENDED TO RELEASE THE RELEASED PARTIES FROM LIABILITY FOR THEIR OWN ORDINARY NEGLIGENCE, INCLUDING NEGLIGENCE OCCURRING BEFORE OR DURING THE RENTAL, TO THE EXTENT SUCH A RELEASE IS LEGALLY ENFORCEABLE.

3.2 Scope of Release

This release applies to legally waivable claims belonging to Participant arising from participation in activities involving ThrillFleet vehicles, whether such claims are known or unknown at the time this Agreement is accepted.

The release is intended to apply to activities conducted in Texas, Oklahoma, and other authorized operating locations, subject to the law applicable to the particular claim.

Participant understands that acceptance of this Agreement may substantially limit their right to recover damages or pursue legal action against the Released Parties for ordinary negligence.

3.3 Exceptions and Nonwaivable Liability

NOTHING IN THIS AGREEMENT RELEASES OR LIMITS LIABILITY FOR GROSS NEGLIGENCE, WILLFUL OR INTENTIONAL MISCONDUCT, FRAUD, VIOLATIONS OF LAW, OR ANY OTHER LIABILITY THAT CANNOT LAWFULLY BE WAIVED OR LIMITED.

If a portion of the release is determined to be unenforceable, the remaining enforceable provisions shall continue to apply to the extent permitted by law.

3.4 No Guarantee of Safety or Mechanical Reliability

Participant acknowledges that ThrillFleet may inspect, maintain, repair, and prepare its rental vehicles, but no maintenance or inspection procedure can guarantee that unexpected mechanical failures, equipment defects, or hazardous conditions will never occur.

ThrillFleet does not guarantee that a particular vehicle, riding location, trail, or recreational activity will be free from hazards.

Nothing in this section relieves ThrillFleet of any inspection, maintenance, or safety obligation imposed by applicable law.

4. INDEMNIFICATION AND FINANCIAL RESPONSIBILITY

4.1 Indemnification for Participant Conduct

To the fullest extent permitted by applicable law, Participant agrees to indemnify and hold harmless ThrillFleet and the other Released Parties against reasonable, documented third-party claims, damages, losses, and expenses directly arising from Participant’s negligent or intentional misconduct, unlawful activity, unauthorized operation, or material breach of this Agreement.

This obligation applies only to the extent such indemnification is legally enforceable and does not require Participant to indemnify ThrillFleet for liability arising from ThrillFleet’s own negligence unless such an obligation is expressly and lawfully established.

4.2 Vehicle Damage and Rental Financial Obligations

Renters remain responsible for verified vehicle damage, loss, missing equipment, recovery expenses, and other financial obligations to the extent established by ThrillFleet’s Terms of Service, the applicable rental agreement, and governing law.

The Security Deposit does not constitute insurance and does not limit the Renter’s total financial responsibility for otherwise recoverable losses.

This Agreement does not make every Participant automatically responsible for the Renter’s contractual debts solely because they signed a liability waiver.

4.3 Reasonable Costs of Enforcement

Where permitted by applicable law and an enforceable agreement, a Participant responsible for a covered loss may also be responsible for reasonable recoverable attorney’s fees, court costs, and other expenses directly associated with enforcing the applicable obligation.

No provision of this Agreement requires reimbursement of costs or fees that cannot lawfully be imposed.

4.4 Continuing Obligations

Lawfully incurred financial and indemnification obligations arising during participation may continue after the rental ends, subject to applicable law and the governing agreements.

5. NO PARTICIPANT INSURANCE OR GUARANTEE OF COVERAGE

5.1 No Personal Insurance Provided

PARTICIPANT ACKNOWLEDGES THAT THRILLFLEET DOES NOT PROVIDE PERSONAL ACCIDENT, MEDICAL, OR PERSONAL LIABILITY INSURANCE COVERAGE TO RENTERS, OPERATORS, OR PASSENGERS THROUGH THIS AGREEMENT.

Participants are responsible for determining whether their own insurance policies provide protection for injuries, vehicle damage, or other losses associated with off-road recreational activities.

5.2 Insurance Limitations

Personal automobile, health, recreational vehicle, or other insurance policies may exclude or restrict coverage for rented off-road vehicles and related activities.

ThrillFleet makes no representation that any insurance maintained by a Participant will cover a particular claim or incident.

The absence of participant insurance does not relieve ThrillFleet of liability that cannot lawfully be released.

5.3 No Limitation of Financial Responsibility

The absence of insurance, expiration of a Security Deposit authorization, or release of a deposit does not automatically eliminate a Renter’s otherwise valid financial obligations.

Any amounts owed must be established and recovered in accordance with applicable law and the governing rental agreements.

6. VEHICLE CONDITION, INCIDENTS, AND DOCUMENTATION

6.1 Vehicle Condition and Inspection

ThrillFleet may document vehicle condition before and after rentals through photographs, videos, inspections, mechanical evaluations, or other reasonably appropriate procedures.

Participants agree to reasonably cooperate with applicable inspection procedures and promptly report known damage, defects, warning indicators, or unsafe conditions before operation.

A Participant’s inspection or acceptance of a vehicle does not eliminate any nonwaivable legal duty owed by ThrillFleet.

6.2 Incident Reporting

Participants must promptly notify ThrillFleet of known accidents, collisions, rollovers, injuries, mechanical malfunctions, vehicle damage, theft, fire, submersion, or other significant incidents involving rented equipment.

Continued operation after discovering a serious mechanical or safety issue is prohibited unless ThrillFleet has authorized continued use and operation is otherwise lawful and safe.

6.3 Cooperation and Documentation

Participants agree to provide reasonably requested information concerning accidents, incidents, or vehicle damage, including factual descriptions, photographs, videos, and other relevant evidence reasonably available to them.

Damage charges, investigations, Security Deposit procedures, and related payment obligations shall be governed by ThrillFleet’s Terms of Service and applicable rental agreements.

Nothing in this section establishes automatic fault or liability based solely on an incomplete inspection record or missing photograph.

7. EMERGENCY MEDICAL TREATMENT

7.1 Emergency Medical Assistance

Participant acknowledges that off-road recreational activities may occur in remote locations where cellular service, emergency personnel, medical facilities, and recovery services are not immediately available.

Participant consents to emergency medical assessment and treatment when reasonably necessary, subject to applicable law and the medical professional’s independent judgment.

7.2 Medical Expenses

Participant acknowledges that emergency medical treatment, transportation, hospitalization, and related services may result in substantial costs.

Participant remains responsible for medical expenses to the extent imposed by applicable law and agreements with healthcare providers.

ThrillFleet does not undertake a contractual obligation to provide medical insurance or arrange medical treatment merely by providing rental equipment.

Nothing in this provision releases ThrillFleet from any legally established responsibility that cannot lawfully be waived.

7.3 Emergency Response Limitations

Participant acknowledges that emergency assistance may be delayed due to remote locations, terrain, weather, limited communications, or other circumstances.

ThrillFleet does not guarantee the availability, response time, or outcome of third-party emergency or medical services.

8. GOVERNING LAW AND DISPUTE RESOLUTION

8.1 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas to the fullest extent permitted by applicable law, without regard to conflict-of-law principles.

The parties agree that Texas law shall govern their contractual relationship wherever legally permissible.

Nothing in this Agreement excludes or overrides mandatory laws, regulations, or public policies of Oklahoma or another jurisdiction that cannot lawfully be displaced by contractual agreement.

8.2 Binding Arbitration

To the fullest extent permitted by applicable law, disputes, claims, or controversies arising out of or relating to this Agreement, rental participation, or the use of ThrillFleet vehicles shall be resolved through final and binding arbitration in accordance with the arbitration procedures established in Section 15.2 of ThrillFleet’s Terms of Service.

The Federal Arbitration Act shall govern the arbitration agreement to the extent applicable, with applicable state arbitration law governing where the federal statute does not apply.

Arbitration shall be administered by the American Arbitration Association under its applicable Consumer Arbitration Rules, unless the parties mutually agree to another qualified neutral provider.

Denton County, Texas, shall be the preferred arbitration location. Remote proceedings or an alternative legally required location may be used in accordance with the applicable arbitration rules.

Arbitration fees and procedures shall be governed by the applicable rules and mandatory law. The arbitrator may award relief available under applicable substantive law.

8.3 Jury Trial and Class Proceeding Waivers

To the extent legally enforceable, Participant and ThrillFleet agree that covered disputes shall be resolved through individual arbitration rather than a jury trial or class proceeding.

Nothing in this provision waives a procedural right that cannot lawfully be waived.

8.4 Informal Dispute Resolution

Before commencing arbitration of a covered dispute, the complaining party shall provide written notice reasonably describing the dispute and allow thirty (30) days for attempted informal resolution, except where applicable law or the governing arbitration rules require otherwise.

8.5 Exceptions and Severability

Small claims matters and requests for judicial relief expressly permitted by applicable law or the Terms of Service may be pursued in an appropriate court.

If an arbitration venue or procedural requirement is found unenforceable, the remaining arbitration terms shall continue to the extent legally permissible.

9. MINOR PASSENGER PARTICIPATION

9.1 Parental Consent Requirement

Minors may participate only as passengers in vehicles approved by ThrillFleet for passenger use and in accordance with applicable law, manufacturer requirements, and riding-area regulations.

A parent or legal guardian must complete ThrillFleet’s separate Minor Passenger Parental Consent, Assumption of Risk & Release of Liability Agreement before the minor participates.

9.2 Eligibility and Safety

Minor passengers must meet applicable manufacturer seating and physical-fit requirements, properly use all installed safety restraints, and comply with mandatory safety rules.

Minors may not operate ThrillFleet rental vehicles.

9.3 Minor’s Independent Legal Rights

A parent or guardian’s authorization permits the minor’s participation but does not necessarily waive the minor’s independent personal injury claims.

Nothing in this Agreement represents that a parent, guardian, or other adult can extinguish claims belonging to a minor where applicable law prohibits such a release.

10. ACKNOWLEDGMENT, ELECTRONIC ACCEPTANCE, AND FINAL PROVISIONS

10.1 Voluntary Acceptance

PARTICIPANT ACKNOWLEDGES THAT THEY HAVE READ THIS AGREEMENT, UNDERSTAND THE RISKS AND POTENTIAL LEGAL CONSEQUENCES OF PARTICIPATION, AND VOLUNTARILY ACCEPT ITS TERMS.

PARTICIPANT SPECIFICALLY ACKNOWLEDGES THAT SECTION 3 CONTAINS AN EXPRESS RELEASE OF CLAIMS ARISING FROM THRILLFLEET’S OWN ORDINARY NEGLIGENCE TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

10.2 Electronic Signatures and Records

Participant agrees that an electronic signature, required acknowledgment checkbox, or other affirmative electronic acceptance may establish agreement to these terms to the extent permitted by applicable law.

ThrillFleet may retain records of the agreement version accepted, booking identification, acceptance timestamp, and related electronic confirmation information.

Each adult Participant must separately accept this Agreement where required by ThrillFleet.

10.3 Severability

If any provision is determined to be invalid, unlawful, or unenforceable, that provision shall be limited or severed to the extent legally permissible without affecting the remaining enforceable provisions.

10.4 Entire Agreement and Incorporated Terms

This Agreement and the ThrillFleet Terms of Service, together with properly incorporated rental-specific disclosures and agreements, govern the Participant’s rights and obligations relating to the subjects addressed herein.

In the event of a conflict, the provision specifically addressing the relevant subject matter shall control, except where otherwise required by applicable law.

10.5 Continuing Effect

The provisions concerning assumption of risk, legally enforceable releases, indemnification, financial obligations, and dispute resolution shall survive completion of the rental to the extent permitted by applicable law.
