THRILLFLEET – PARENTAL WAIVER & RELEASE OF LIABILITY
Last Updated: October 23, 2026
Applicable Locations: Texas, Oklahoma, and Other Authorized Rental Locations
This Minor Passenger Parental Consent, Assumption of Risk & Release of Liability Agreement (“Agreement”) is entered into between ThrillFleet, LLC (“ThrillFleet”) and the parent or legal guardian (“Parent/Guardian”) of a minor participating as a passenger in recreational off-road vehicle activities involving ThrillFleet rental equipment.
By electronically signing or otherwise affirmatively accepting this Agreement, the Parent/Guardian authorizes the minor’s participation, acknowledges the risks of off-road recreational activities, and agrees to the releases, responsibilities, and conditions contained herein to the fullest extent permitted by applicable law.
This Agreement supplements ThrillFleet’s Terms of Service, Rental Participant Agreement, and applicable safety requirements.
Nothing in this Agreement is intended to extinguish a minor’s independent legal rights where those rights cannot lawfully be waived.
1. PARENTAL AUTHORIZATION AND ELIGIBILITY
1.1 Authority to Consent
The Parent/Guardian represents that they are the minor’s lawful parent or legal guardian and possess the legal authority necessary to authorize the minor’s participation.
The Parent/Guardian voluntarily grants permission for the identified minor to participate as a passenger in a ThrillFleet recreational vehicle, subject to the conditions of this Agreement.
1.2 Passenger-Only Participation
Minors are permitted to participate solely as passengers in vehicles specifically approved by ThrillFleet for passenger use.
Minors may not operate ThrillFleet vehicles. All vehicle operators must be adults expressly authorized by ThrillFleet and must satisfy applicable licensing, eligibility, and operating requirements.
The Parent/Guardian acknowledges that minor passengers must meet all applicable manufacturer seating and physical-fit requirements, including the ability to sit with their back against the seat, place both feet flat on the floor, reach the designated passenger handhold, and properly use the installed safety restraints.
ThrillFleet reserves the right to refuse or discontinue a minor’s participation when eligibility or safety requirements are not satisfied.
1.3 Compliance with Rental Policies
The Parent/Guardian agrees that the minor’s participation is subject to ThrillFleet’s applicable rental conditions, safety requirements, manufacturer operating restrictions, riding-area rules, and federal, state, and local laws.
The Parent/Guardian agrees to communicate applicable safety rules to the minor in a manner appropriate to the minor’s age and understanding.
2. ACKNOWLEDGMENT AND ASSUMPTION OF RISK
2.1 Recognition of Inherent Risks
THE PARENT/GUARDIAN ACKNOWLEDGES THAT OFF-ROAD RECREATIONAL ACTIVITIES ARE INHERENTLY DANGEROUS AND MAY RESULT IN SERIOUS BODILY INJURY, PERMANENT DISABILITY, PARALYSIS, OR DEATH.
These risks include, without limitation:
- Vehicle collisions, rollovers, and loss of control.
- Passenger ejection or impact with vehicle structures.
- Mechanical malfunction or unexpected equipment failure.
- Uneven terrain, steep slopes, rocks, mud, water crossings, and obstacles.
- Sudden changes in weather, traction, or visibility.
- Actions or mistakes of drivers, passengers, or other riders.
- Delayed emergency response or limited access to medical assistance.
The Parent/Guardian acknowledges that these risks may exist despite reasonable precautions, vehicle maintenance, appropriate safety equipment, or responsible operation.
2.2 Vehicle Conditions and Mechanical Risks
ThrillFleet may inspect, maintain, repair, and prepare its rental vehicles. Nevertheless, off-road vehicles are subject to substantial mechanical stress and unpredictable operating conditions.
No inspection or maintenance procedure can guarantee that a vehicle will remain free from unexpected mechanical failure during use.
Nothing in this Agreement relieves ThrillFleet of maintenance, inspection, or safety obligations that cannot lawfully be waived.
2.3 Safety Equipment and Passenger Protection
All minor passengers must occupy designated passenger seats and properly use installed seat belts or safety harnesses throughout vehicle operation.
Vehicle doors or passenger barriers must remain properly secured, and passengers must keep their hands, arms, feet, and legs inside the vehicle during operation.
The Parent/Guardian acknowledges that vehicle manufacturers, including Polaris for its RZR vehicles, recommend or instruct occupants to wear approved helmets, protective eyewear, and other protective equipment.
All protective equipment required by applicable law, riding-area rules, or ThrillFleet’s expressly established rental conditions must be used.
Where protective equipment is not legally or contractually mandatory, the Parent/Guardian acknowledges the risks associated with declining recommended equipment, including increased exposure to head, eye, and bodily injuries.
The Parent/Guardian is responsible for decisions concerning the minor’s optional personal protective equipment, subject to applicable law and ThrillFleet’s rental policies.
2.4 Voluntary Authorization
The Parent/Guardian acknowledges that permitting the minor to participate is a voluntary decision.
The Parent/Guardian understands the substantial risks involved and knowingly authorizes the minor’s participation despite those risks.
3. RELEASE OF LIABILITY BY PARENT OR GUARDIAN
3.1 Express Release of Parent’s Own Claims
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PARENT/GUARDIAN, ACTING IN THEIR INDIVIDUAL CAPACITY, EXPRESSLY RELEASES AND DISCHARGES THRILLFLEET, LLC, ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, AND REPRESENTATIVES FROM CLAIMS PERSONALLY BELONGING TO THE PARENT/GUARDIAN ARISING OUT OF THE MINOR’S PARTICIPATION IN ACTIVITIES INVOLVING THRILLFLEET RENTAL VEHICLES.
THIS RELEASE EXPRESSLY INCLUDES THE ORDINARY NEGLIGENCE OF THRILLFLEET AND THE OTHER RELEASED PARTIES, INCLUDING ORDINARY NEGLIGENCE RELATED TO VEHICLE INSPECTION, MAINTENANCE, PREPARATION, DELIVERY, OR OTHER RENTAL ACTIVITIES, TO THE EXTENT SUCH CLAIMS MAY LAWFULLY BE RELEASED.
3.2 Scope and Limitations
The release applies only to claims that the Parent/Guardian has legal authority to release.
Nothing in this Agreement releases ThrillFleet or any other party from gross negligence, willful or intentional misconduct, fraud, violations of law, or liability that cannot lawfully be waived.
Nothing in this Agreement guarantees that a minor’s independent personal injury claims are waived or extinguished.
3.3 No Guarantee of Safety
The Parent/Guardian acknowledges that participation in off-road recreational activities involves risks that cannot be entirely eliminated.
ThrillFleet does not guarantee that a vehicle, riding location, or recreational activity will be free from hazards, accidents, or unexpected mechanical failures.
This acknowledgment does not eliminate any nonwaivable duty imposed on ThrillFleet by applicable law.
4. PARENTAL RESPONSIBILITY AND INDEMNIFICATION
4.1 Responsibility for Minor’s Conduct
The Parent/Guardian agrees to take reasonable steps to ensure that the minor complies with applicable passenger safety rules, vehicle restrictions, and lawful instructions.
The Parent/Guardian agrees not to knowingly permit the minor to operate a vehicle, interfere with vehicle controls, disable safety equipment, or engage in conduct that creates an unreasonable risk of injury or damage.
4.2 Responsibility for Damage and Third-Party Claims
To the extent permitted by applicable law, the Parent/Guardian agrees to indemnify ThrillFleet for reasonable, documented losses and third-party claims directly resulting from the Parent/Guardian’s own negligent or intentional conduct, breach of this Agreement, or authorization of prohibited conduct.
Any additional responsibility for vehicle damage or loss shall be governed by the applicable rental agreement and governing law.
This provision does not impose automatic liability solely because the Parent/Guardian is the minor’s parent or guardian.
4.3 Limitations on Indemnification
Nothing in this Agreement requires the Parent/Guardian to indemnify ThrillFleet for liability resulting from ThrillFleet’s gross negligence, intentional misconduct, or other conduct for which indemnification is prohibited by law.
This provision is not intended to circumvent legal restrictions on waiving or extinguishing a minor’s independent personal injury claims.
Any recoverable attorney’s fees, defense expenses, or related costs must be authorized by applicable law or an enforceable contractual obligation.
5. EMERGENCY MEDICAL AUTHORIZATION
5.1 Consent to Emergency Medical Assistance
The Parent/Guardian authorizes emergency medical personnel, first responders, and qualified healthcare providers to provide emergency medical evaluation and treatment to the minor when reasonably necessary following an accident, injury, or medical emergency.
This authorization is intended to facilitate emergency assistance and does not replace any additional consent required by applicable law.
5.2 Medical Expenses
The Parent/Guardian acknowledges that emergency medical treatment, transportation, hospitalization, and related services may result in substantial expenses.
The Parent/Guardian accepts responsibility for medical expenses to the extent imposed by applicable law and any applicable agreements with medical providers.
ThrillFleet does not undertake a contractual obligation to provide or pay for personal medical insurance or medical treatment merely by permitting the minor to participate.
Nothing in this section releases ThrillFleet from legally established liability for medical expenses caused by conduct for which ThrillFleet remains responsible under applicable law.
5.3 Emergency Response Limitations
The Parent/Guardian acknowledges that off-road riding locations may be remote and that emergency response, rescue, cellular communications, and access to medical facilities may be delayed.
ThrillFleet does not guarantee the availability or response time of emergency medical services.
6. NO PARTICIPANT INSURANCE PROVIDED
6.1 Insurance Disclosure
THRILLFLEET DOES NOT PROVIDE PERSONAL ACCIDENT, MEDICAL, OR PERSONAL LIABILITY INSURANCE COVERAGE TO MINOR PASSENGERS OR THEIR PARENTS OR GUARDIANS THROUGH THIS RENTAL AGREEMENT.
The Parent/Guardian acknowledges that participating in off-road recreational activities may create financial exposure arising from injury, medical expenses, property damage, or other losses.
6.2 Independent Insurance Decisions
The Parent/Guardian is responsible for determining whether any personal health, accident, or other insurance available to the minor covers the planned activity.
ThrillFleet makes no representation that the Parent/Guardian’s personal insurance will cover off-road recreational activities or injuries involving rented vehicles.
The absence of participant insurance does not eliminate any liability or legal duty otherwise imposed on ThrillFleet by applicable law.
7. GOVERNING LAW AND DISPUTE RESOLUTION
7.1 Governing Law
This Agreement shall be governed by the laws of the State of Texas to the fullest extent permitted by applicable law.
Nothing in this Agreement excludes mandatory laws, regulations, or public policies of Oklahoma or another jurisdiction that cannot lawfully be displaced by contractual agreement.
7.2 Dispute Resolution and Arbitration
To the fullest extent permitted by applicable law, disputes between ThrillFleet and the Parent/Guardian concerning the Parent/Guardian’s own contractual rights or obligations under this Agreement shall be resolved according to the applicable dispute resolution and arbitration provisions of ThrillFleet’s Terms of Service.
This provision does not purport to require a minor to arbitrate an independent legal claim where the minor cannot lawfully be bound to such an agreement.
7.3 Informal Resolution
Before initiating arbitration of a covered dispute, the Parent/Guardian agrees to provide ThrillFleet with written notice describing the dispute and allow thirty (30) days for an attempt at informal resolution, except where applicable law requires otherwise.
8. ELECTRONIC ACCEPTANCE AND FINAL ACKNOWLEDGMENT
8.1 Electronic Agreement
The Parent/Guardian acknowledges that this Agreement may be accepted through an electronic signature, required acknowledgment checkbox, or other affirmative electronic acceptance process.
Electronic acceptance shall have legal effect to the extent permitted by applicable electronic signature laws.
8.2 Acknowledgment of Understanding
BY ACCEPTING THIS AGREEMENT, THE PARENT/GUARDIAN ACKNOWLEDGES THAT:
- They have read and understand the Agreement.
- They possess legal authority to authorize the minor’s participation.
- They voluntarily permit the minor to ride as a passenger.
- They understand that off-road riding may result in serious injury, permanent disability, or death.
- They understand that ThrillFleet does not provide personal injury insurance for the minor.
- They understand that this Agreement contains a release of certain claims personally belonging to the Parent/Guardian, including claims involving ThrillFleet’s ordinary negligence, to the fullest extent permitted by law.
- They understand that their acceptance does not necessarily eliminate the minor’s independent legal rights.
- They agree to the applicable passenger safety requirements and other enforceable provisions of this Agreement.
8.3 Severability
If any provision of this Agreement is determined to be invalid or unenforceable, that provision shall be severed or limited to the extent legally permissible without invalidating the remaining enforceable provisions, provided the essential purpose of this Agreement can still be fulfilled.
