These Terms of Service govern all access to and use of the ThrillFleet platform, website, and related services. ThrillFleet, LLC operates as a Texas-based marketplace allowing individuals to list, rent, and coordinate the use of recreational vehicles including SxSs, ATVs, dirt bikes, snowmobiles, boats, and jet skis. By accessing or using the platform, you acknowledge that you have read, understood, and agreed to these Terms of Service, along with all incorporated policies, including the Waiver of Liability, Host Agreement Addendum, Risk & Protection Disclosure, Safety and Requirements, and the Parental Waiver where applicable. If you do not agree to these Terms, you may not use ThrillFleet.
- ACCEPTANCE AND SCOPE OF USE
1.1 Agreement to Terms
Your access to and continued use of the ThrillFleet platform constitutes a binding agreement to these Terms of Service. You also consent to the collection, use, and handling of information as described in the Privacy Policy. ThrillFleet may update these Terms at any time, and continued use of the platform after changes become effective constitutes acceptance of the revised terms.
1.2 Eligibility to Use the Platform
The platform may only be used by individuals who are at least twenty-five years of age and who possess a valid, government-issued driver’s license. Age, identity, and eligibility may be verified through third-party tools prior to confirming any booking. ThrillFleet reserves the right to deny access or terminate accounts where eligibility cannot be confirmed.
1.3 Marketplace Relationship
ThrillFleet is a neutral marketplace facilitating the connection between hosts who own recreational vehicles and renters who wish to use those vehicles. ThrillFleet does not own, manage, operate, inspect, or maintain any vehicle listed on the platform. Hosts act as independent providers, and renters acknowledge that any rental relationship arises directly between the host and the renter. ThrillFleet does not guarantee the condition, safety, legal compliance, or suitability of any vehicle.
- RENTAL AGREEMENTS AND BOOKING TERMS
2.1 Formation of Rental Agreements
All rentals facilitated through ThrillFleet constitute a direct agreement between the host and the renter. A booking is not final until the host accepts it, verification requirements are successfully completed, and payment is processed. ThrillFleet does not control host acceptance decisions and does not guarantee vehicle availability, suitability, or performance.
2.2 Renter Requirements
Renters must be at least twenty-five years old, must hold a valid driver’s license, and must meet any additional requirements imposed by the host or required by law. ThrillFleet or the host may request identity verification before confirming a booking. A booking may be cancelled or denied if verification cannot be completed to the satisfaction of ThrillFleet or the host.
2.3 Rental Parameters and Host Discretion
Rental periods, pickup times, drop-off times, delivery options, and on-property usage rules are established exclusively by the host and displayed on the listing page or checkout screen. Hosts may establish supplemental conditions relating to safety, equipment handling, route restrictions, and vehicle care. Renters are responsible for reviewing and complying with all listing terms before booking.
2.4 Vehicle Condition and Pre-Ride Inspection
Renters agree to inspect the vehicle upon pickup and to immediately notify the host of any visible or suspected damage. Use of the vehicle following pickup constitutes acceptance that the vehicle is in satisfactory operating condition. Hosts are responsible for ensuring that vehicles are clean, properly maintained, and reasonably safe for use prior to delivery or pickup.
2.5 Responsibility During the Rental Period
The renter assumes full responsibility for the vehicle from the start of the rental period until it is returned to the host. This responsibility includes safe operation, compliance with all applicable laws, protection against damage or theft, and adherence to terrain, trail, and weather restrictions. Any misuse, prohibited activity, or unauthorized third-party use constitutes a breach of this Agreement and may result in financial liability, account suspension, or both.
- PAYMENTS, FEES, AND REFUNDS
3.1 Payment Processing
All payments for bookings are processed at the time of checkout through ThrillFleet’s third-party payment provider. By submitting payment information, users authorize all charges associated with the booking, including service fees, taxes, deposits, and any amounts arising from damage, rule violations, or additional use. ThrillFleet does not store, process, or control payment credentials and bears no liability for actions or errors by third-party processors.
3.2 Service Fees and Host Compensation
ThrillFleet charges a service fee for each completed rental transaction. The applicable fee is disclosed at the time of booking. Hosts receive payment for their rentals net of these fees and any applicable deductions. Payments to hosts may be withheld, delayed, or reversed in cases of disputes, chargebacks, fraud concerns, policy violations, or renter claims requiring review.
3.3 Security Deposits and Additional Assessments
A refundable security deposit may be required for certain vehicles or listings. Deposits are used to cover damage, excessive wear, cleaning fees, towing, retrieval, late returns, unauthorized use, or other costs resulting from a renter’s actions. ThrillFleet may facilitate collection and disbursement of such deposits, but the ultimate right to recover damages belongs to the host.
3.4 Cancellations and Refunds
Cancellations submitted at least twenty-four hours before the scheduled rental start time are eligible for a full refund. Late cancellations, no-shows, and bookings terminated due to policy violations are non-refundable. ThrillFleet does not issue refunds for ordinary weather conditions, including rain, wind, heat, cold, or similar variations. Hosts may cancel a booking if safety concerns, verification failures, or mechanical issues arise. Hosts may, at their discretion, offer alternative times or reschedule options in cases of severe weather or conditions they believe make operation unsafe. ThrillFleet does not guarantee or process weather-based refunds and does not reimburse for travel or incidental expenses.
3.5 Chargebacks and Disputed Payments
If a user initiates a chargeback or payment dispute, ThrillFleet may suspend or terminate the associated account, withhold payments to the host, or pursue reimbursement for any losses incurred. Users agree to cooperate with ThrillFleet in providing information necessary to resolve payment disputes.
- USER CONDUCT, RESPONSIBILITIES, AND PROHIBITED ACTIVITIES
4.1 General Conduct Expectations
All users must interact with the platform and each other in a lawful, respectful, and responsible manner. Renters and hosts agree to communicate only for purposes necessary to coordinate bookings, pickups, returns, and safety matters. Misuse of another user’s personal information or attempts to solicit off-platform transactions are strictly prohibited.
4.2 Renter Responsibilities During Use
Renters must operate vehicles safely, skillfully, and in accordance with all applicable laws, trail rules, and environmental regulations. Renters must wear appropriate safety gear, follow any instructional guidance provided by the host, and avoid terrain or conditions beyond their ability or the vehicle’s capability. The renter assumes full responsibility for any citation, fine, damage, loss, or injury resulting from their conduct or failure to comply with operational requirements.
4.3 Host Responsibilities for Listed Vehicles
Hosts must ensure that all vehicles listed on ThrillFleet are well-maintained, clean, properly functioning, and safe for the intended use. Hosts are responsible for disclosing any known mechanical issues, safety limitations, or special operating requirements. A host’s failure to maintain or disclose relevant conditions may result in account restrictions or suspension.
4.4 Prohibited Uses of Vehicles
Renters may not use any vehicle for illegal activities, racing, stunts, high-risk maneuvers, commercial activity without written approval, towing or hauling beyond rated capacity, or any use that violates host instructions or applicable law. Vehicles may not be operated by anyone other than the verified renter unless expressly authorized in writing by the host and permitted by law.
4.5 Reporting and Incident Obligations
Renters must immediately report any accident, damage, malfunction, or unsafe condition to the host and, if required by law, to local authorities. Failure to report incidents promptly constitutes a breach of these Terms and may result in financial liability or removal from the platform.
- MARKETPLACE LIMITATIONS, RISK ALLOCATION, AND INSURANCE DISCLAIMER
5.1 Marketplace Role and Operational Limitations
ThrillFleet functions solely as a digital platform that connects independent hosts with renters. ThrillFleet does not own, operate, inspect, repair, store, or maintain any vehicle listed on the platform, nor does it supervise, train, or oversee the conduct of hosts or renters. All operational control, safety instruction, and vehicle-related responsibilities rest with the host and renter. By using the platform, users acknowledge that ThrillFleet has no responsibility for vehicle condition, safety, legal compliance, mechanical soundness, route choices, terrain hazards, or the actions of any user.
5.2 Assumption of Risk
Recreational vehicles such as SxSs, ATVs, dirt bikes, snowmobiles, boats, and jet skis involve inherent risks, including collision, rollover, mechanical failure, environmental hazards, weather conditions, and operator error. By participating in a rental through ThrillFleet, users voluntarily assume all risks of injury, death, property damage, or other loss that may arise from the use or operation of any listed vehicle. Users agree that they have read and understand all applicable Waivers, Safety Requirements, and Risk Disclosures incorporated into these Terms.
5.3 No Insurance Provided by ThrillFleet
ThrillFleet does not provide insurance of any kind for hosts or renters. This includes no coverage for vehicle damage, personal injury, property loss, theft, liability claims, towing costs, medical expenses, or any other incident arising from a booking. All users are solely responsible for obtaining whatever insurance they believe necessary to protect their interests. Hosts and renters acknowledge that failure to procure insurance may result in significant financial exposure and that ThrillFleet bears no responsibility for such losses.
5.4 Host and Renter Liability
Hosts are solely responsible for ensuring that their vehicles meet all legal, registration, safety, and insurance requirements. Renters are solely responsible for any damage or loss occurring during the rental period and for any harm caused to persons or property. ThrillFleet may, at its discretion, facilitate communication or assist in processing claims, but is not responsible for adjudicating disputes, determining fault, or compensating any party for losses.
5.5 Limitation of ThrillFleet’s Liability
To the fullest extent permitted by Texas law, ThrillFleet shall not be liable for injuries, damages, losses, delays, lost profits, or incidental or consequential damages arising out of or relating to any rental, vehicle use, host conduct, renter conduct, listing, communication, mechanical failure, environmental condition, or any event occurring before, during, or after the rental period. Users agree that ThrillFleet’s total liability, if any, shall not exceed the amount of fees paid for the disputed transaction.
- CANCELLATIONS, WEATHER CONDITIONS, AND RESCHEDULING POLICIES
6.1 Renter Cancellations
Renters may cancel a confirmed booking up to twenty-four hours before the scheduled start time for a full refund of the rental amount. Cancellations submitted after this deadline, as well as failure to appear for pickup or delivery, are non-refundable. ThrillFleet may deny refund requests where the renter has violated platform rules, failed verification requirements, or engaged in conduct that prevented proper booking fulfillment.
6.2 Host Cancellations
Hosts may cancel a booking if safety concerns, mechanical issues, verification failures, or other reasonable circumstances prevent the rental from proceeding. Host-initiated cancellations should be made as early as practicable. Where a host cancels due to the renter’s failure to meet eligibility or verification requirements, the renter is not entitled to a refund except as required by law or determined by ThrillFleet.
6.3 Weather-Related Conditions
ThrillFleet does not issue refunds based on ordinary or expected weather conditions, including rain, wind, temperature variation, or similar changes that do not render vehicle operation unsafe. Renters are responsible for evaluating expected weather before booking. In cases of severe conditions such as lightning, flooding, or extreme wind, a host may determine that operating the vehicle is unsafe and may offer to reschedule the booking in their discretion. ThrillFleet does not guarantee rescheduling availability or alternative dates and does not process or guarantee weather-related refunds.
6.4 Disruptions, Delays, and Unusable Conditions
If a rental cannot be completed due to factors unrelated to ThrillFleet, including mechanical failure, environmental hazards, trail closures, or renter misconduct, refunds or adjustments are determined by the host and not by ThrillFleet. ThrillFleet bears no responsibility for travel expenses, lost time, or incidental costs resulting from cancellations, delays, or operational limitations encountered during the rental period.
- ACCOUNT REQUIREMENTS, VERIFICATION, AND PLATFORM ACCESS RULES
7.1 Account Creation and Accuracy of Information
To use the platform, users must create an account and provide complete, accurate, and current information. Users agree to update their account details as necessary to maintain accuracy. ThrillFleet may suspend or terminate accounts that contain false, incomplete, or misleading information. Users are responsible for safeguarding their login credentials and for all activity conducted under their account.
7.2 Identity and Eligibility Verification
ThrillFleet may require users to complete verification procedures at any time, including providing a valid driver’s license, government-issued identification, or additional documentation requested to confirm identity, age, or eligibility. Third-party verification providers may be used, and users consent to the processing of their information for these purposes. If verification cannot be successfully completed, ThrillFleet may cancel bookings, deny platform access, or close the associated account.
7.3 Compliance with Laws and Platform Policies
Users agree to comply with all applicable federal, state, and local laws when using the platform or operating a vehicle. Users also agree to review and adhere to all ThrillFleet policies, including the Safety and Requirements Policy, Waiver of Liability, Host Agreement Addendum, and Risk & Protection Disclosure. Failure to comply may result in account restriction, cancellation of bookings, financial liability, or permanent removal from the platform.
7.4 Account Suspension and Termination
ThrillFleet may suspend, restrict, or terminate any account at its discretion where policy violations, safety concerns, fraudulent behavior, unpaid amounts, or disputes arise. Termination may occur without prior notice in cases involving risk to other users or to platform. Users remain responsible for any outstanding obligations or liabilities that arose prior to account termination.
7.5 Communication and Use of Personal Information
Users may communicate with one another only for the limited purpose of coordinating bookings, logistics, and safety matters. Contact information obtained through platform may not be used for solicitation, marketing, off-platform transactions, or any unrelated purpose. ThrillFleet reserves right to monitor communications to ensure safety, prevent fraud, and enforce these Terms.
- DISPUTE RESOLUTION, GOVERNING LAW, AND ARBITRATION
8.1 Governing Law
These Terms of Service, and any dispute arising out of or relating to the use of the ThrillFleet platform, shall be governed exclusively by the laws of the State of Texas, without regard to conflict-of-law principles. Users acknowledge that ThrillFleet operates as a Texas-based LLC and consent to the application of Texas substantive law to all matters involving the platform.
8.2 Mandatory Binding Arbitration
Except where prohibited by applicable law, any dispute, claim, or controversy arising between a user and ThrillFleet shall be resolved through binding arbitration rather than in court. Arbitration shall be conducted in Denton County, Texas before a single neutral arbitrator. Users agree that arbitration shall be the exclusive method of resolving disputes, that arbitrator’s decision shall be final, and that judgment on award may be entered in any court with proper jurisdiction.
8.3 Waiver of Jury Trial and Class Action
By using the platform, users knowingly waive the right to a jury trial and the right to participate in any class action, class arbitration, representative action, or consolidated proceeding. Claims must be asserted individually, and the arbitrator’s authority is limited to resolving disputes between the parties on an individual basis.
8.4 Exceptions to Arbitration Requirement
ThrillFleet may bring an action in court to seek injunctive or equitable relief where necessary to protect intellectual property, enforce platform integrity, prevent fraud, or address misuse of personal information. Users may also bring claims in a small claims court located in Texas if such claims fall within that court’s jurisdictional limits.
8.5 Informal Resolution Requirement
Before initiating arbitration, users must first provide written notice describing the dispute and allow ThrillFleet thirty days to attempt informal resolution. If resolution is not achieved within that period, either party may proceed to arbitration. Communication during this informal process is without prejudice and does not constitute an admission of liability.
- INTEGRATION WITH OTHER POLICIES AND DOCUMENT HIERARCHY
9.1 Incorporated Policies
These Terms are expressly incorporated with and shall be read together with ThrillFleet’s Waiver of Liability, Host Agreement Addendum, Safety and Requirements Policy, Risk and Protection Disclosure, and Parental Waiver and Release of Liability. By using platform, users confirm that they have reviewed and accepted each incorporated document. These supplemental policies contain material terms regarding risk, liability, conduct, insurance, and operational expectations, and form an essential part of agreement between ThrillFleet and all users.
9.2 Consistency and Interpretation
If any conflict exists between these Terms and any incorporated policy, the document that more specifically addresses the subject matter of the conflict shall govern. Terms designed to limit liability, allocate risk, or disclaim warranties shall be interpreted broadly to the maximum extent permitted by Texas law. Section headings are for convenience only and do not affect the interpretation of the terms.
9.3 Updates and Modifications
ThrillFleet may amend or replace these Terms or any incorporated policy at its discretion. Updated terms become effective once posted on the platform, and continued use constitutes acceptance of the revised documents. Users are responsible for reviewing all updates. ThrillFleet may notify users of material changes but is not obliged to do so.
- FINAL PROVISIONS
10.1 Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect. Invalid term shall be interpreted or modified, if possible, to reflect the intent of the parties while remaining enforceable under Texas law.
10.2 No Waiver
The failure of ThrillFleet to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver is effective only if made in writing and signed by an authorized representative of ThrillFleet.
10.3 Assignment
Users may not assign or transfer their rights or obligations under these Terms without prior written consent from ThrillFleet. ThrillFleet may assign its rights or obligations to an affiliate, successor, or purchaser without user consent.
10.4 Entire Agreement
These Terms, together with all incorporated documents and policies, constitute the entire agreement between ThrillFleet and its users and supersede all prior understandings, agreements, and representations relating to the platform.
