WAIVER OF LIABILITY

READ CAREFULLY: THIS IS A LEGAL RELEASE OF YOUR RIGHTS.
By booking a rental through ThrillFleet, you (the “Renter”) agree as follows:

1. ASSUMPTION OF RISK

I UNDERSTAND THAT OPERATING ANY RECREATIONAL VEHICLE INVOLVES INHERENT RISKS, INCLUDING BUT NOT LIMITED TO COLLISION, ROLLOVER, EQUIPMENT FAILURE, DROWNING, SERIOUS INJURY, OR DEATH. I VOLUNTARILY ASSUME ALL SUCH RISKS, INCLUDING THOSE ARISING FROM MY OWN ACTIONS, THE NEGLIGENCE OF HOSTS, OR VEHICLE CONDITION.

2. RELEASE OF LIABILITY

I RELEASE AND HOLD HARMLESS THRILLFLEET, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, AFFILIATES, AND HOSTS FROM ANY LIABILITY FOR INJURIES, DEATH, OR PROPERTY DAMAGE INCURRED DURING THE RENTAL PERIOD, INCLUDING THOSE RESULTING FROM ORDINARY NEGLIGENCE.

This release does not apply to claims arising from gross negligence, willful misconduct, or intentional harm.

3. INDEMNIFICATION

I AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THRILLFLEET, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, AFFILIATES, AND HOSTS FROM ANY AND ALL CLAIMS, DAMAGES, ACTIONS, OR EXPENSES (INCLUDING ATTORNEY’S FEES AND COURT COSTS) ARISING FROM:

  • My actions, omissions, or violations of law,
  • My breach of this agreement or of ThrillFleet policies,
  • The conduct of unauthorized or intoxicated users,
  • Any third-party claims related to my use of the vehicle.

4. DAMAGE RESPONSIBILITY

I AM FINANCIALLY RESPONSIBLE FOR ALL DAMAGE TO THE RENTED VEHICLE OR THIRD-PARTY PROPERTY CAUSED DURING THE RENTAL PERIOD.

  • Photo/Video Documentation Required: I must upload before and after photos/videos of the vehicle from all sides (front, rear, both sides, interior, and top view). Failure to provide photos means I forfeit my right to dispute damage claims.
  • Deposit Capture: Deposits may be partially or fully captured to cover verified damages, based only on professional shop estimates as outlined in the ThrillFleet Risk & Protection Disclosure.
  • Reporting Deadlines: Hosts must report damage within 24 hours after the booking window ends. I acknowledge this policy may affect the handling of claims against me.

5. COMPLIANCE WITH LAWS & SAFETY RULES

I will:

  • Hold a valid license or permit for the rented vehicle type,
  • Use required safety gear (helmets, life jackets, protective eyewear, etc.),
  • Never operate a vehicle under the influence of drugs, alcohol, or impairing medication,
  • Follow all host instructions, riding rules, and applicable laws.

6. MINORS

I CERTIFY THAT I AM AT LEAST 25 YEARS OLD.

  • Minors are prohibited from operating vehicles.
  • If a minor is a passenger, a signed Parental Waiver must be completed before the booking begins.
  • I accept full liability for any claims or damages involving minors in my booking.

7. BINDING AGREEMENT

This waiver is binding upon me, my heirs, executors, administrators, and assigns.

Consent Tracking: Consent is recorded electronically through ThrillFleet’s booking system with timestamp and IP address.

Governing Law & Venue: This waiver is governed by Texas law. Any disputes shall be resolved exclusively in the state or federal courts of Denton County, Texas.

Acknowledgment: I understand I am waiving substantial legal rights by signing this document.
