ThrillFleet Risk & Protection Disclosure

ThrillFleet is committed to transparency and safety. This Risk & Protection Disclosure explains the risks, responsibilities, and protections associated with using our platform. Please read carefully before booking or listing a vehicle.
1. Your Responsibility as a Renter
- Minimum Age: You must be at least 25 years old to rent any vehicle through ThrillFleet.
- Licensing: You must hold a valid, active driverâs license (and boating certificate where applicable).
- Behavior: You agree to operate all vehicles safely, responsibly, and in compliance with the law. Reckless use, unauthorized riders, and intoxicated operation are strictly prohibited.
- Safety Gear: You are responsible for wearing required safety equipment (helmets, life jackets, protective eyewear, etc.). Hosts may refuse handoff if you arrive unprepared.
- Photos Required: You must upload before and after photos or videos of the vehicle from every angle of the vehicle: front, sides, rear, inside, and from above. Failure to provide photos means you lose the right to defend yourself against damage claims.
2. Your Responsibility as a Host
- Vehicle Condition: Hosts are solely responsible for ensuring their vehicles are safe, maintained, and compliant with all laws.
- Verification: Hosts must check renter ID, sobriety, and readiness at pickup/delivery.
- Cancellations: Last-minute cancellations (within 24 hours of booking start) result in automatic penalties:
- 1st offense â Restarting the trust badge counter and a warning.
- 2nd offense â $100 penalty deducted from your next payout.
- 3rd offense â $200 penalty deducted from your next payout
- 4th offense â $300 penalty deducted from your next payout and a 90 day suspension from the platform.
- Photos Required: Hosts must upload before and after photos or videos of every rental of the vehicle from every angle of the vehicle: front, sides, rear, inside, and from above. Failure to provide photos means you lose the right to claim damages.
3. Booking Windows vs. Pickup/Dropoff Times
- Platform Booking Window:
- Every rental is measured from 12:00 AM on the start date to 11:59 PM on the end date.
- This window controls deposits, reporting deadlines, and payout timing.
- Pickup & Dropoff Times:
- Actual pickup/dropoff times are separately agreed between the host and renter.
- These agreed times do not change the official booking window.
- Example: A 1-day booking for June 10 runs 12:00 AM â 11:59 PM. But the host and renter may agree on pickup at 9 AM and dropoff at 7 PM.
4. Deposits, Damages & Payouts
- Deposits: A security deposit is authorized at booking.
- If no damage is reported â deposit auto-releases after 24 hours from booking end.
- If damage is reported â deposit may be partially or fully captured based on shop estimates.
- Damage Reporting:
- Hosts must initiate a claim through the ThrillFleet platform within 24 hours of the booking window end by pressing the âMake Damage Claimâ button in their dashboard. This records the official claim timestamp. After initiating, hosts must email photos and documentation to inspections@thrillfleet.com. Claims without platform initiation will not be honored.
- If a claim is filed, the deposit hold is extended until the claim is resolved. If no claim is filed, the deposit auto-releases 24 hours after the booking end.
- Hosts then have 5 days from the booking window end to provide professional shop estimates.
- Failure to report damage within 24 hours forfeits the right to claim.
- Failure to report a damage estimate within 5 days forfeits the right to claim.
- Repair Costs: Renters are responsible for the full cost of damages caused by misuse, negligence, or violation of this agreement, even if such costs exceed the deposit amount.
- Refunds:
- If a host cancels, renter receives a full refund immediately.
- If no damage is reported within 24 hours, deposits are fully released.
- If damage is reported, only the documented amount on the professional shop estimate(s) provided within 5 days may be captured from the deposit. The rest will be refunded back to the customer.
5. ThrillFleetâs Role
- ThrillFleet is a third-party marketplace only.
- ThrillFleet does not:
- Own or maintain vehicles
- Provide or verify insurance
- Guarantee the quality or safety of vehicles or renters
- Cover damages, accidents, or injuries
- ThrillFleet enforces platform rules through deposits, penalties, and commissions.
- ThrillFleetâs platform records the timing of claims and enforces deposit holds accordingly but does not adjudicate or pay damages itself.
- Identity Verification:
ThrillFleet uses third-party identity verification providers (such as Persona and Stripe Identity) to confirm user age and identity where applicable. These verifications are conducted directly by the third-party service, not by ThrillFleet. ThrillFleet does not guarantee the accuracy, completeness, or outcome of any third-party verification and is not responsible for technical failures, delays, or errors that may occur in the verification process. By using the platform, users agree that identity verification results are provided âas is,â and that each host remains responsible for confirming renter identity at the time of vehicle handoff.
6. Inherent Risks
Operating recreational vehicles carries serious risks, including:
- Collision, rollover, or equipment failure
- Injury or death
- Drowning or water accidents
- Unpredictable terrain, weather, or other riders
By using ThrillFleet, you acknowledge these risks and accept full personal responsibility.
7. Legal Protections
- Release of Liability: To the fullest extent permitted by law, you release and hold harmless ThrillFleet, its owners, employees, and affiliates from any and all claims, damages, injuries, or liabilities arising from your use of the platform or any rental arranged through it.
- Indemnification: You agree to indemnify and defend ThrillFleet against any claims, damages, losses, or expenses including reasonable attorneyâs fees, court costs, and expenses arising from your actions, negligence, or violations of law.
- No Insurance Provided: ThrillFleet does not provide insurance of any kind. By using the platform, you agree that you are solely responsible for obtaining any insurance coverage you deem necessary.
- Governing Law & Venue: This agreement is governed by the laws of the State of Texas. Any disputes will be resolved exclusively in the state or federal courts located in Denton County, Texas.
8. Required Legal Documents
Before renting or hosting, you must review and accept:
- Terms of Service
- Waiver of Liability
- Host Agreement Addendum
- Parental Waiver (if underage passengers are involved)
Acceptance is recorded through mandatory checkboxes and timestamped consent.
9. Stay Safe, Be Smart
Your best protection is responsibility:
- Remember: before/after photos are mandatory. Without them, you cannot file or dispute damage claims.
- Follow riding rules and wear safety gear
- Respect the outdoors and the vehicle youâre operating
