ThrillFleet is committed to transparency, user safety, and clear communication of risks associated with recreational vehicle rentals. This Risk & Protection Disclosure outlines the responsibilities, operational expectations, and inherent risks applicable to all Hosts and Renters using the ThrillFleet platform. By booking or listing a vehicle, you acknowledge and accept these disclosures and agree to comply with all related policies, including the Terms of Service, Waiver of Liability, Host Agreement Addendum, and Safety & Requirements Policy.

  1. RENTER RESPONSIBILITIES

1.1 Eligibility and Licensing Requirements

A renter must be at least twenty-five years of age and possess a valid, active driver’s license. For watercraft or vehicles requiring special certification, the renter must also possess any legally required boating or operator credentials. Use of the ThrillFleet platform constitutes a representation that all licensing requirements have been met.

1.2 Safe and Lawful Operation

Renters agree to operate all vehicles safely and responsibly, with full compliance with state and local laws. Reckless behavior, intoxicated operation, unauthorized riders, off-limit terrain use, or any conduct that increases risk to persons or property is strictly prohibited. Hosts may refuse handoff if the renter arrives impaired or unprepared.

1.3 Safety Gear Requirements

Renters are responsible for wearing all required safety equipment, including helmets, flotation devices, protective eyewear, and any additional gear appropriate to the vehicle type. A Host may deny access to the vehicle if the renter does not possess or use necessary safety gear, and no refund is owed in these circumstances.

1.4 Mandatory Photo and Video Documentation

Renters must upload complete before-and-after photo or video documentation of the vehicle for every rental. This includes the front, sides, rear, interior, and overhead perspectives. Failure to provide complete documentation results in forfeiture of the renter’s right to dispute or defend against any damage claims submitted by the Host.

  • HOST RESPONSIBILITIES

2.1 Vehicle Safety and Legal Compliance

The Host is solely responsible for ensuring that every listed vehicle is safe, maintained, and compliant with all applicable laws and regulations. This includes proper registration, mechanical upkeep, safety equipment, and suitability for the type of terrain or activity represented in listing.

2.2 Renter Verification at Handoff

The Host agrees to verify the renter’s identity, age, valid driver’s license, boating card where necessary, and general readiness to operate the vehicle safely. The Host must refuse the rental if the renter appears impaired, intoxicated, or otherwise unfit to safely operate the vehicle.

2.3 Reliability and Cancellation Obligations

The Host acknowledges that canceling a booking within twenty-four hours of the scheduled start time results in automatic penalties applied to upcoming payouts. Progressive consequences include warnings, trust badge resets, monetary deductions, and possible suspension. Continued violations may result in permanent removal from the platform.

2.4 Mandatory Photo and Video Documentation

The Host must upload before-and-after photos or videos documenting the full condition of the vehicle for each rental. Required angles include the front, sides, rear, interior areas, and overhead views. Incomplete or missing documentation may prevent the Host from pursuing a valid damage claim and may limit deposit recovery.

  • BOOKING WINDOWS AND PICKUP/DROPOFF TIMES

3.1 Platform Booking Window Definition

All rentals on ThrillFleet operate according to the platform-defined booking window. This window begins at 12:00 a.m. on rental start date and ends at 11:59 p.m. on the rental end date. The booking window governs deposit holds, reporting deadlines, damage claim timelines, and payout scheduling, regardless of actual pickup or return arrangements between Host and Renter.

3.2 Separate Pickup and Dropoff Arrangements

Pickup and dropoff times agreed upon by the Host and Renter are independent of the official booking window. These personal arrangements do not modify the platform’s deadlines for claim submission, deposit releases, or documentation requirements.

3.3 Illustrative Example

For a one-day booking scheduled for June 10, the booking window runs from 12:00 a.m. to 11:59 p.m. on that date. The Host and Renter may agree to meet at 9:00 a.m. for pickup and at 7:00 p.m. for return, but these times do not affect the beginning or end of the booking window or the applicable reporting deadlines.

  • DEPOSITS, DAMAGES, AND PAYOUTS

4.1 Security Deposit Authorization

A security deposit is authorized at the time of booking and held until the end of the booking window. If no damage is reported within twenty-four hours after the booking window closes, the deposit is automatically released in full. Deposits do not constitute insurance and are used solely for verified, documented physical damage or loss.

4.2 Damage Reporting Requirements

If damage occurs, the Host must submit a damage claim through the Platform by using the “Make Damage Claim” feature within twenty-four hours after the booking window ends. Submission through this feature establishes the official timestamp. Following submission, the Host must email supporting documentation, including photos and descriptions, to inspections@thrillfleet.com. Claims not initiated through the Platform will not be recognized.

4.3 Deposit Hold Extensions During Claims

When a valid claim is submitted, the deposit hold is extended until the claim is resolved. Deposits are released only after all required documents have been provided and reviewed, or once the claim period expires without proper submission.

4.4 Professional Repair Estimates

The Host must provide repair estimates from a licensed repair shop within five days of the booking window end. Only actual repair estimates submitted within this timeframe may be collected from renter’s deposit. Any claim lacking timely estimates forfeits right to recover funds.

4.5 Deposit Capture and Refunds

If a host cancels a booking, the renter receives a full refund. If damage is properly reported and documented, the amount equal to the verified repair estimate may be captured from the deposit, and any remaining balance is refunded to the renter. If no damage is reported, the deposit releases automatically within twenty-four hours.

4.6 Limitations on Recovery

ThrillFleet only facilitates the capture of documented repair costs up to the amount of the authorized deposit. Any additional recovery beyond the deposit must be pursued directly between the Host and the Renter.

  • THRILLFLEET’S ROLE

5.1 Marketplace Function Only

ThrillFleet operates exclusively as a third-party marketplace platform that facilitates connections between Hosts and Renters. ThrillFleet does not own, operate, control, inspect, store, maintain, or repair any vehicles listed on the platform. ThrillFleet has no involvement in the handoff, operation, or return of vehicles and does not supervise user conduct.

5.2 No Insurance or Damage Coverage

ThrillFleet does not provide insurance coverage of any kind and does not verify, guarantee, or require Hosts or Renters to maintain insurance. ThrillFleet does not pay for or reimburse damage, loss, injury, or liability. All risks associated with participation, operation, and hosting remain solely with the respective users.

5.3 Enforcement of Platform Rules

ThrillFleet’s primary enforcement mechanisms include the use of deposits, penalties, account restrictions, and platform removal. ThrillFleet records the timing of claims, flags incomplete submissions, and manages deposit holds but does not adjudicate disputes or determine fault between Hosts and Renters.

5.4 Identity Verification Process

ThrillFleet uses a third-party provider, WithPersona, to facilitate age and identity verification where applicable. Verification occurs directly through the third-party service. ThrillFleet does not guarantee the accuracy or completeness of verification results and is not responsible for technical errors, delays, or failed submissions. Hosts must still confirm identity and eligibility at the time of vehicle handoff.

5.5 Limitations of Verification

Identity verification confirms age and identity but does not establish competence, skill level, sobriety, or insurance coverage. Hosts retain responsibility for ensuring that the renter appears capable and prepared to operate the vehicle safely.

  • INHERENT RISKS

6.1 Nature of Recreational Vehicle Risks

All users acknowledge that operating recreational vehicles—including off-road vehicles, ATVs, UTVs, dirt bikes, snowmobiles, motorcycles, watercraft, and similar equipment—carries inherent and significant risks. These risks arise from factors such as collision, rollover, sudden loss of control, equipment failure, unpredictable terrain, and environmental conditions.

6.2 Potential for Injury or Death

Users understand that participation may result in serious injury, permanent disability, drowning, traumatic harm, or death. These risks cannot be entirely eliminated, even with proper maintenance, instruction, or safety gear.

6.3 Unpredictable Environmental Conditions

Users acknowledge that rapidly changing weather, water conditions, wildlife, debris, and other riders on trails or waterways may create dangerous or unforeseeable hazards beyond any party’s control.

6.4 Personal Responsibility for Safety

By using the ThrillFleet platform, all participants assume full responsibility for evaluating conditions, assessing their abilities, exercising proper judgment, and taking all precautions necessary to protect themselves, their passengers, and the vehicle.

  • LEGAL PROTECTIONS

7.1 Release of Liability

To the fullest extent permitted by Texas law, all users release and hold harmless ThrillFleet, its owners, officers, employees, agents, and affiliates from any claim, injury, loss, damage, or liability arising from or connected to the use of the platform or any rental arranged through it. This release applies regardless of whether the claim arises from negligence, vehicle defects, unsafe conditions, user conduct, or unforeseen hazards.

7.2 Indemnification Obligations

Users agree to indemnify, defend, and hold harmless ThrillFleet from all claims, damages, losses, liabilities, attorney’s fees, and court costs arising from their conduct, negligence, rule violations, or unlawful actions. Renters and Hosts remain personally responsible for any harm caused to persons, property, or equipment during participation.

7.3 No Insurance Provided

ThrillFleet does not provide insurance coverage for Hosts, Renters, passengers, vehicles, or third parties. Users acknowledge that they are solely responsible for obtaining whatever insurance they deem necessary, including liability, collision, medical, or property coverage.

7.4 Governing Law and Arbitration

This Disclosure is governed by the laws of the State of Texas. Any dispute arising from or relating to this Disclosure, or the use of the ThrillFleet platform, shall be resolved exclusively through binding arbitration in Denton County, Texas. Users waive the right to a jury trial or participation in class or representative actions to the fullest extent permitted by law.

  • REQUIRED LEGAL DOCUMENTS

8.1 Mandatory Review and Acceptance

Before participating in any rental activity as a Host or Renter, you must review and accept all required ThrillFleet legal documents. Acceptance is recorded through mandatory checkboxes and timestamped electronic consent during the booking or listing process. Participation on the platform is not permitted without full acceptance of these terms.

8.2 Incorporated Agreements

All users acknowledge that their conduct is governed by the ThrillFleet Terms of Service, Waiver of Liability, Host Agreement Addendum, Safety and Requirements Policy, and, when applicable, the Parental Waiver for minor passengers. These documents collectively define the rights, responsibilities, and limitations associated with platform use.

8.3 Binding Effect

Acceptance of these documents forms a binding agreement between the user and ThrillFleet. Continued use of the platform, completion of bookings, or listing of vehicles reaffirms acceptance of all required legal terms.

  • SAFETY REMINDERS

9.1 Importance of Documentation

All users acknowledge that before-and-after photos or videos are mandatory for every rental. Failure to complete this documentation eliminates the ability to file, dispute, or defend against damage claims. Proper documentation is a user’s strongest protection in the event of a disagreement.

9.2 Personal Responsibility for Safety

Users agree to exercise sound judgment, follow all operational rules, and wear appropriate safety gear at all times. Responsible operation, awareness of surroundings, and adherence to Host instructions significantly reduce the risk of injury or property damage.

9.3 Respect for Property and Environment

Users agree to treat all vehicles with care, operate them only in permitted areas, and respect natural environments, trails, waterways, and public lands. Misuse of the vehicle or disregard for environmental conditions increases inherent risks and may result in liability.
