PARENTAL WAIVER AND RELEASE OF LIABILITY

This Parental Waiver and Release of Liability explains the conditions under which a minor may ride as a passenger during any booking arranged through ThrillFleet, LLC. By providing electronic acknowledgment during checkout or registration, the parent or legal guardian grants permission for the minor to participate and agrees to all terms set forth in this Agreement, which supplements ThrillFleet’s Terms of Service, Waiver of Liability, and Safety & Requirements Policy.
- PERMISSION AND ELIGIBILITY
1.1 Legal Authority to Consent
You affirm that you are lawful parent or legal guardian of the minor participant and possess full authority to grant permission for the minor to ride as a passenger during a ThrillFleet booking.
1.2 Passenger-Only Participation
The minor will participate solely as a passenger and will remain under the supervision of a verified renter who is at least twenty-five years of age and legally permitted to operate the vehicle.
1.3 Acceptance of ThrillFleet Policies
You confirm that you have reviewed and agree to all applicable ThrillFleet policies, including Terms of Service, Waiver of Liability, Safety & Requirements Policy, and Risk & Protection Disclosure. These documents govern activity and apply in full to minor’s participation.
1.4 Acknowledgment of Risk Factors
You understand that participation involves inherent risks, including collision, rollover, equipment malfunction, water-related hazards, environmental conditions, and other unpredictable factors that may result in injury, property damage, or death.
- ASSUMPTION OF RISK
2.1 Recognition of Significant Danger
You acknowledge that riding as a passenger in recreational vehicles, including off-road vehicles, watercraft, motorcycles, dirt bikes, snowmobiles, and similar equipment, carries a substantial risk of injury or death. These risks cannot be fully eliminated even with proper supervision, safety gear, or responsible operation.
2.2 Unpredictability of Conditions
You understand that terrain, weather, environmental factors, mechanical issues, and the actions of other riders or drivers may create hazardous and unforeseeable circumstances beyond the control of ThrillFleet, the host, or the renter supervising the minor.
2.3 No Inspection or Insurance by ThrillFleet
You acknowledge that ThrillFleet does not own, inspect, maintain, or insure any vehicle used during a booking. All vehicles are controlled and maintained solely by independent hosts, and participation occurs at your and the minor’s own risk.
2.4 Voluntary Participation
You confirm that the minor’s involvement is entirely voluntary and that you knowingly, freely, and willingly accept all risks—whether known or unknown—associated with the minor’s participation as a passenger.
- RELEASE OF LIABILITY
3.1 General Release of Claims
To the fullest extent permitted by Texas law, you release and discharge ThrillFleet, LLC, its owners, officers, employees, contractors, affiliates, and the individual host providing the vehicle from any and all claims, demands, actions, damages, losses, or liabilities arising from or connected to the minor’s participation as a passenger.
3.2 Scope of the Release
This release applies to all injuries, death, property damage, and losses of any kind, whether caused by environmental conditions, equipment malfunction, operator error, or other participants. It applies to incidents occurring before, during, or after the booking period.
3.3 Release for Negligence
You expressly agree that this release includes claims based on ordinary negligence, equipment failure, improper maintenance, or unsafe conditions. You understand that by agreeing to this section, you are waiving the right to bring legal action alleging that ThrillFleet or the host failed to ensure safety.
3.4 No Reliance on Representations
You acknowledge that no guarantees or assurances have been made regarding the safety, condition, or performance of any vehicle. Your decision to allow the minor to participate is based solely on your own judgment and acceptance of the inherent risks involved.
- INDEMNIFICATION
4.1 Parent or Guardian Responsibility for Claims
You agree to fully indemnify and defend ThrillFleet, LLC, its owners, employees, contractors, affiliates, and all participating hosts from any claim, demand, or action brought by or on behalf of the minor, or by any third party, arising out of the minor’s participation in any ThrillFleet booking.
4.2 Coverage of Costs and Expenses
Your indemnification obligations extend to all expenses incurred by ThrillFleet or any host as a result of such claims, including attorney’s fees, court costs, administrative fees, expert fees, and any other expenses related to defending or responding to the claim.
4.3 Responsibility for Minor’s Conduct
You acknowledge that you are solely responsible for the conduct, actions, and safety of the minor during the booking activity. You agree to indemnify ThrillFleet and hosts for any harm, damage, or loss caused by the minor, whether intentional, negligent, or accidental.
4.4 Continuing Effect
Your duty to indemnify remains in effect even after the booking has ended, the minor’s participation has concluded, or your ThrillFleet account has been closed.
- MEDICAL AUTHORIZATION
5.1 Consent to Emergency Treatment
You authorize emergency medical personnel, healthcare providers, or first responders to administer any medical treatment deemed necessary for the minor in the event of an accident, injury, or medical condition arising during participation in a ThrillFleet booking.
5.2 Financial Responsibility for Medical Care
You agree that all medical costs, including transportation, evaluation, treatment, hospitalization, medication, and follow-up care, are your sole responsibility. ThrillFleet and hosts bear no obligation to pay for, arrange, or reimburse any medical expenses incurred on behalf of minor.
5.3 No Liability for Medical Outcomes
You release ThrillFleet and all hosts from any liability related to decisions made by emergency personnel, healthcare providers, or medical facilities. ThrillFleet is not responsible for delays, treatment errors, or outcomes resulting from emergency or medical intervention.
5.4 Continuing Effect of Authorization
This medical authorization remains effective for duration of minor’s participation in ThrillFleet activities and continues to apply to any subsequent incidents arising from that participation.
- NO INSURANCE PROVIDED
6.1 Lack of Coverage by ThrillFleet
You acknowledge that ThrillFleet does not provide insurance coverage of any kind for hosts, renters, passengers, or third parties. ThrillFleet does not insure against personal injury, medical expenses, property damage, vehicle damage, or any loss arising from participation in a booking.
6.2 Responsibility for Insurance Decisions
Any insurance coverage you wish to obtain for the minor, including medical, liability, accident, or supplemental protection, is solely your responsibility. ThrillFleet does not review, verify, or guarantee the existence or adequacy of any insurance maintained by hosts or renters.
6.3 Acceptance of Financial Risk
By permitting the minor to participate, you accept full financial responsibility for any costs, damages, or losses not covered by insurance you personally maintain. ThrillFleet bears no liability for uninsured or underinsured losses.
- GOVERNING LAW AND ARBITRATION
7.1 Governing Law
This Agreement is governed exclusively by the laws of the State of Texas, without regard to conflict-of-law principles. By permitting the minor to participate in a ThrillFleet activity, you consent to the application of Texas law to all matters arising from or relating to this Agreement.
7.2 Mandatory Binding Arbitration
Any dispute, claim, or controversy arising from or relating to the minor’s participation or to this Agreement shall be resolved through binding arbitration. Arbitration shall take place in Denton County, Texas before a single neutral arbitrator. The arbitrator’s decision shall be final, and judgment may be entered in any court with appropriate jurisdiction.
7.3 Waiver of Jury Trial and Class Actions
You expressly waive the right to a jury trial and the right to participate in any class action, representative action, or collective proceeding. All claims must be brought on an individual basis.
7.4 Informal Resolution Requirement
Before initiating arbitration, you agree to provide written notice to ThrillFleet describing the dispute and allowing thirty days for informal resolution. If the matter is not resolved within this period, either party may proceed to arbitration.
- DIGITAL ACKNOWLEDGMENT
8.1 Legal Effect of Electronic Consent
By checking the required acknowledgment box during checkout, registration, or any other electronic process on the ThrillFleet platform, you agree that this Agreement is binding and enforceable to the same extent as a handwritten signature.
8.2 Confirmation of Understanding and Voluntary Agreement
You confirm that you have read this Agreement in full, understand its terms, and voluntarily accept all risks and responsibilities described herein. You acknowledge that this waiver limits your legal rights and the rights of the minor Participant.
8.3 Certification of Legal Authority
You certify that you are the lawful parent or legal guardian of the minor Participant and possess full authority to grant permission for their involvement in any activity arranged through ThrillFleet.
