1. PLATFORM ROLE AND DISCLAIMER

ThrillFleet operates solely as a third-party marketplace connecting vehicle owners (“Hosts”) with individuals seeking to rent recreational vehicles (“Renters”). THRILLFLEET DOES NOT OWN, OPERATE, MAINTAIN, OR INSPECT ANY VEHICLES, NOR DOES IT VERIFY THE SAFETY, CONDITION, LEGAL COMPLIANCE, OR RENTER QUALIFICATIONS. All transactions are between Hosts and Renters. THRILLFLEET, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES ARE NOT LIABLE FOR ANY INJURIES, DAMAGES, OR LOSSES ARISING FROM USE OF THE PLATFORM OR RENTED VEHICLES.

2. ASSUMPTION OF RISK

RENTERS ASSUME ALL RISKS ASSOCIATED WITH OPERATING RENTED VEHICLES, INCLUDING RISKS OF INJURY, DEATH, OR PROPERTY DAMAGE, WHETHER DUE TO RENTER ACTIONS, HOST NEGLIGENCE, OR VEHICLE CONDITION. Recreational activities involve inherent dangers, and Renters engage at their own risk.

3. HOST RESPONSIBILITIES

Hosts are solely responsible for:
(a) ensuring listing accuracy;
(b) maintaining vehicles in safe, operational condition;
(c) verifying renter qualifications (e.g., valid licenses, sobriety); and
(d) complying with all laws, including maintaining liability insurance with a minimum of $1 million per occurrence.
THRILLFLEET IS NOT LIABLE FOR HOST NEGLIGENCE OR NON-COMPLIANCE.

4. RENTER RESPONSIBILITIES

Renters agree to:
(a) be at least 25 years old;
(b) hold valid licenses/permits for the vehicle type;
(c) operate vehicles safely and legally;
(d) use required safety gear;
(e) refrain from operating under the influence of drugs or alcohol;
(f) prevent unauthorized users from operating vehicles; and
(g) upload valid ID and licenses at booking.
Renters are financially responsible for all damages caused during the rental, including by unauthorized or intoxicated users. Renters are strongly encouraged to carry personal liability insurance.

5. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, THRILLFLEET, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES DISCLAIM ALL LIABILITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM USE OF THE PLATFORM OR RENTED VEHICLES, INCLUDING THOSE ARISING FROM THRILLFLEET’S OR HOSTS’ ORDINARY NEGLIGENCE.

6. INDEMNIFICATION

RENTERS AND HOSTS AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THRILLFLEET, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES FROM ANY CLAIMS, DEMANDS, LOSSES, OR EXPENSES (INCLUDING ATTORNEY FEES) ARISING FROM THEIR USE OF THE PLATFORM OR VEHICLES, INCLUDING THIRD-PARTY CLAIMS AND THOSE RESULTING FROM THRILLFLEET’S OR HOSTS’ ORDINARY NEGLIGENCE.

7. MINORS AND UNAUTHORIZED USERS

Renters must be 25 or older. Minors are prohibited from renting or operating vehicles. If a minor is a passenger, Renters must obtain written parental consent via ThrillFleet’s parental waiver form. Renters are liable for damages or injuries caused by unauthorized users or intoxication.

8. DISPUTE RESOLUTION

This agreement is governed by Texas law. All disputes shall be resolved through binding arbitration in Texas under the American Arbitration Association rules, except where prohibited by law. If arbitration is unavailable, disputes shall be resolved in Texas state or federal courts. If any provision is unenforceable in another jurisdiction, the remaining provisions remain in effect.

9. BINDING AGREEMENT

By using ThrillFleet, users agree to these Terms and the Waiver of Liability. Renters must acknowledge acceptance by checking separate boxes for each document at checkout, after reviewing them via a scroll-through interface. Consent is recorded with timestamps and IP addresses.

READ CAREFULLY: THIS IS A LEGAL RELEASE OF YOUR RIGHTS

By booking a rental through ThrillFleet, you (the “Renter”) agree:

1. ASSUMPTION OF RISK

I UNDERSTAND THAT OPERATING ANY RECREATIONAL VEHICLE INVOLVES INHERENT RISKS, INCLUDING SERIOUS INJURY, DEATH, OR PROPERTY DAMAGE. I VOLUNTARILY ASSUME ALL SUCH RISKS, INCLUDING THOSE ARISING FROM MY ACTIONS, HOST NEGLIGENCE, OR VEHICLE CONDITION.

2. RELEASE OF LIABILITY

I RELEASE AND HOLD HARMLESS THRILLFLEET, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, AFFILIATES, AND HOSTS FROM ANY LIABILITY FOR INJURIES, DEATH, OR DAMAGES INCURRED DURING THE RENTAL PERIOD, INCLUDING THOSE RESULTING FROM THRILLFLEET’S OR HOSTS’ ORDINARY NEGLIGENCE.

3. INDEMNIFICATION

I AGREE TO INDEMNIFY AND DEFEND THRILLFLEET, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND HOSTS FROM ANY CLAIMS, DAMAGES, OR LEGAL ACTIONS, INCLUDING THIRD-PARTY CLAIMS, RESULTING FROM MY ACTIONS, NEGLIGENCE, OR USE OF THE VEHICLE, INCLUDING BY UNAUTHORIZED OR INTOXICATED USERS.

4. DAMAGE RESPONSIBILITY

I am financially responsible for all damage to the rented vehicle or third-party property caused during the rental period, including by unauthorized or intoxicated users.

5. COMPLIANCE WITH LAWS

I will operate the vehicle legally, hold a valid license/permit, use required safety gear, and never operate under the influence of drugs or alcohol.

6. MINORS

I CERTIFY THAT I AM AT LEAST 25 YEARS OLD. Minors are prohibited from operating vehicles. If a minor is a passenger, I will obtain written parental consent via ThrillFleet’s parental waiver form. I am liable for any minor-related claims.

7. BINDING AGREEMENT

THIS WAIVER IS BINDING UPON ME, MY HEIRS, AND ASSIGNS, AND IS GOVERNED BY TEXAS LAW. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS. Consent is recorded with timestamps and IP addresses.
